1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the YoungStars Hope Foundation–Africa website ("Site"), including browsing, applying to volunteer, making a donation, or subscribing to updates. By using the Site or submitting any form on it, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or submit any forms.
Where an action requires it — for example, submitting a volunteer application, a donation, or a newsletter sign-up — you will be asked to actively confirm that you accept these Terms before the action can be completed.
2. Definitions
- "Foundation", "we", "us" means YoungStars Hope Foundation–Africa, [insert registration type and number, e.g. registered under the NGO Coordination Act / as a Trust], of Kitui / Nairobi, Kenya.
- "Site" means this website and all pages, forms and content published on it.
- "You", "User" means anyone accessing or using the Site, including visitors, volunteer applicants, donors and subscribers.
- "Volunteer" means a person who submits a volunteer application through the Site.
- "Donor" means a person who makes a monetary contribution through the Site or via the payment channels it references.
3. Using This Website
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by anyone else. In particular, you agree not to:
- Submit false, misleading, or fraudulent information in any form on the Site;
- Attempt to gain unauthorised access to the Site, its forms, or any related systems;
- Use automated tools (bots, scrapers) to submit forms or harvest data from the Site;
- Upload or transmit anything that contains viruses, malware, or other harmful code;
- Use the Site to harass, defame, or endanger any person, including any child associated with our programs.
We reserve the right to restrict or block access from any user or address that we reasonably believe is engaged in the above.
4. Volunteering
Submitting a volunteer application through the Site is an expression of interest, not a guarantee of placement. We review applications and may contact you for further information, references, or an interview before confirming any role.
Child safeguarding. Because our programs serve minors, volunteers who will interact with young people may be required to provide references, undergo a background/vetting process, and agree to a separate child-safeguarding code of conduct before being placed. We reserve the right to decline or withdraw any volunteer placement where we have safeguarding concerns, at our sole discretion and without obligation to disclose our reasons.
Volunteers act in a personal capacity and not as employees or agents of the Foundation unless separately agreed in writing.
5. Donations
Donations made through the Site are processed via mobile money (e.g. M-Pesa Paybill) or other channels we may reference from time to time. We do not store your M-Pesa PIN or full payment credentials on this Site — payment is completed on your phone or through your provider's own secure system.
Please double-check the amount and your phone number before confirming a donation. Donations are generally non-refundable, except where a payment was made in error due to a technical fault on our part, in which case contact us using the details in Section 16 and we will review the matter in good faith.

6. Newsletter & Communications
If you subscribe to our newsletter or submit a volunteer or contact form, you consent to receive email or phone communications from us related to your submission, our programs, events, and impact updates. You may unsubscribe from newsletter emails at any time using the link in those emails, or by contacting us directly.
7. Your Submissions
You are responsible for the accuracy of any information you submit through our forms (name, contact details, message content, etc.). Please do not submit sensitive personal information beyond what a form asks for. Any content you submit must not be unlawful, defamatory, or infringe another person's rights.
8. Intellectual Property
The Site's text, design, graphics, and logo are owned by the Foundation or used under licence, except where otherwise credited (for example, third-party stock photography). You may view and share pages of the Site for personal, non-commercial purposes, but may not reproduce, modify, or redistribute Site content for commercial use without our written permission.
9. Third-Party Services
The Site uses trusted third-party services to operate securely and efficiently, including a form-delivery provider for volunteer and newsletter submissions, mobile money providers for donations, and content-delivery networks for fonts, icons, and layout libraries. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the availability or content of external sites we link to.
10. Privacy & Children's Data
Our full Privacy Policy explains what personal data we collect and how we use it, in line with Kenya's Data Protection Act, 2019. In short: we collect only what a form asks for, use it only for the stated purpose (responding to your application, processing a donation, or sending updates you asked for), and do not sell your data.
This Site's public forms are intended for adults (18+) acting on their own behalf — for example, a parent or guardian enquiring about our youth programs. We do not knowingly collect personal data directly from children through these forms. Any information about a minor participating in our programs is collected separately, offline or through a guardian, with appropriate consent.
11. Disclaimers
The Site is provided "as is" and "as available." While we take reasonable care to keep information accurate and the Site secure and available, we do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components, and we make no warranty as to the completeness or accuracy of any content on it.
12. Limitation of Liability
To the fullest extent permitted by law, the Foundation will not be liable for any indirect, incidental, or consequential loss arising from your use of the Site, a delayed or failed donation transaction caused by a third-party payment provider, or reliance on information published on the Site. Nothing in these Terms limits liability that cannot lawfully be limited.
13. Termination of Access
We may suspend or restrict your access to the Site or its forms at any time, without notice, if we reasonably believe you have breached these Terms or pose a risk to the Foundation, our staff, volunteers, or the young people we serve.
14. Governing Law
These Terms are governed by the laws of the Republic of Kenya, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Kenya.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in how the Site works or in applicable law. The "Last updated" date at the top of this page will reflect the most recent revision. Continuing to use the Site after changes are posted means you accept the revised Terms.
